Georgia Eviction Process Timeline
Below is a summary of the aspects outside of the landlord’s control that dictate the amount of time it takes to evict a tenant in Georgia. With that being said, these estimates can vary greatly, and some time periods may not include weekends or legal holidays.
- Initial Notice Period – 60 days for “at-will” tenants; not specified for any other eviction types.
- Issuance/Service of Summons and Complaint – A few days to a few weeks, depending on the service method.
- Answer is Filed – 7 days after the summons is issued.
- Court Hearing and Ruling on the Eviction – A few days to a few weeks; longer if an appeal is filed.
- Issuance of Writ of Possession – 7 days after the judgment is issued in favor of the landlord.
- Return of Possession – A few days to a few weeks, depending on how quickly the writ is executed.

Fulton County Cost
Here is the cost for your dispossessory case to be managed by our team:
- Fulton County Filing Fees -- $110.00 for one tenant and all others. (Additional named tenants add $35 each)
- Eviction Management Fees - $150.00 -- Covers: Eviction Process Management, negotiations / communications with tenant, and much more - see video.
- Attorney Fees (optional) - $250 -- One appearance in magistrate court. -- You are expected to accompany the attorney in contested cases.
Total due is - $510.00 -- Step 1: Demand Letter $50* Step 2. $100 + Filing fee $110.00 = $210.00* Upon notice of court date + $250.00*
*Paypal Fee - 3.5% processing fee for Credit or Debit card or pay with Zelle - Payment links will be in your portal.
<Additional fees will be charged for Writ of Possession and physical set-out. -- Very few of our cases ever need a physical set out.>

- Gwinnett County Filing Fees -- $115.00 for one tenant and all others. (Additional named tenants add $30 each)
- Eviction Management Fees - $150.00 -- Covers: Eviction Process Management, negotiations / communications with tenant, and much more - see video.
- Attorney Fees (optional) - $250 -- One appearance in magistrate court. -- You are expected to accompany the attorney in contested cases.
Total due is - $515.00 -- Step 1: Demand Letter $50* Step 2. $100 + Filing fee $115.00 = $215.00* Step 3. Attorney Fee $250.00* (Due upon notice of court date)
